Why a checklist matters

Even a well-drafted Wasiyyah is only ONE document. A complete Muslim estate plan needs 10-12 supporting documents so your executor is not scrambling during grief. Prepare them once — review every 3 years or after a major life event.

The core 12

(1) Wasiyyah (Islamic will). (2) Faraid distribution note explaining the 2/3+ split to family. (3) Sealed confidential annex — passwords, crypto seed phrases, safe deposit box location. (4) Executor appointment letter and executor briefing document. (5) Guardianship declaration for minor children — critical for Muslim families in non-Muslim-majority countries. (6) Funeral & burial wishes (ghusl, kafan, funeral prayer, cemetery preference, du'a al-mayyit). (7) Debt register — who you owe, who owes you. (8) Asset register — property deeds, brokerage statements, insurance policies, business ownership certificates. (9) Digital-life plan — Google Inactive Manager, Apple Legacy Contact, Facebook Legacy Contact all pre-configured. (10) Personal letter to each family member (blessings, forgiveness, du'a requests). (11) Ongoing sadaqah jariyah plan — recurring charity in your name, waqf endowments, orphan sponsorships. (12) Copy of your ID, passport, birth certificate, marriage certificate, and children's birth certificates in a single family folder.

Where to store them

Two locations minimum: (a) with your executor (physical folder + digital copy) and (b) a fireproof home safe or bank safe-deposit box. Never keep only one copy. Consider a third digital copy in an encrypted cloud folder shared with a trusted family member.

Guardianship — the most-overlooked document

If you die while your children are minors and you have NOT nominated a guardian in writing, most non-Muslim-majority courts assign one from state welfare systems — potentially non-Muslim. Include a written guardianship declaration in your estate plan naming a competent Muslim guardian and a backup. This alone is worth the entire exercise for families with young children.

The Prophet ﷺ said: "When a person dies, all their deeds cease except three: sadaqah jariyah, beneficial knowledge, or a righteous child who prays for them" (Sahih Muslim 1631).

  • How often should I update?

    Every 3 years minimum, or immediately after: marriage, divorce, birth, death of a beneficiary, major asset acquisition, or relocation.

  • Is a printed will enough?

  • What if my family disagrees with Islamic distribution?

    Include a Faraid distribution note in your Wasiyyah explaining Quran 4:11-12 to your family. Also attach a personal message to each family member. Non-Muslim spouses and non-heirs should be provided for via the 1/3 Wasiyyah portion.
