Islamic Inheritance (Faraid) in South Africa
How the common-law system of South Africa interacts with Qur’anic faraid shares, and how South African Muslims can plan an estate that is valid in both frames.
Does South Africa enforce Islamic inheritance automatically?
No. South Africa’s common-law framework does not partition a Muslim estate by faraid unless the deceased left a valid Islamic will directing the executor to do so, or the case is heard in a specialised religious/sharia court. This is why an Islamic will (wasiyyah) is important even in countries where sharia is not the default civil law.
The three deduction steps before any share is calculated
(1) Funeral costs. (2) Debts, including unpaid Zakat and unpaid mahr. (3) Any valid wasiyyah, capped at 1/3 of what remains. Only after these three deductions do the fixed Qur’anic shares apply to what is left.
Which madhhab do South African Muslims follow?
Hanafi/Shafi’i. Differences with other Sunni schools show up mainly in edge cases: distant kindred (dhawī al-arhām), the grandmother’s share when both paternal and maternal lines conflict, and joint problems (musharraka / ʿumariyya / akdāriyya). South Africa probate + Islamic partition — the two-track approach
The cleanest structure: (a) execute the local probate/succession filing to satisfy South Africa’s legal system, and (b) have the executor voluntarily distribute the assets by faraid before any legal shares are paid. In some cases, all adult heirs signing a family agreement to distribute by faraid is enough — provided it doesn’t violate mandatory forced-share rules for minors.
